1. Acceptance of Terms

By creating an account, accessing, or using InsurifyAI (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service. We may update these Terms from time to time, and your continued use of the Service after such changes constitutes acceptance of the revised Terms.

2. Description of Service

InsurifyAI is an AI-powered platform that provides AI-assisted guidance for individual consumers managing auto insurance claims. The Service includes, but is not limited to:

• AI-generated demand letters, appeal letters, and other correspondence
• Real-time call coaching during conversations with insurance adjusters
• Settlement analysis and claims strategy suggestions
• Vehicle appraisal and diminished value estimates
• Document management and organization tools
• A desktop screen overlay assistant
• Access to a state-specific legal knowledge base

3. Eligibility

You must meet all of the following criteria to use the Service:

• You must be at least 18 years of age.
• You must be a resident of the United States.
• You must have the legal capacity to enter into a binding agreement.
• You must not have been previously suspended or removed from the Service.

By creating an account, you represent and warrant that you meet all eligibility requirements listed above.

4. Account Registration & Security

To use the Service you must create an account and provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized use of your account.
• Keeping your account information accurate and up to date.

We reserve the right to suspend or terminate accounts that contain inaccurate information or are used in violation of these Terms.

5. Payment Terms

InsurifyAI operates on a pay-per-claim pricing model with credit-based bundles. Key payment terms:

• Pay-per-claim: Fees are charged when you activate AI features for a specific claim. Pricing tiers include Starter ($19.99), Standard ($39.99), and Pro ($79.99).
• Credit system: You may purchase credit bundles in advance, which are applied when activating claims.
• Payment processing: All payments are processed securely through Stripe. We do not store your full credit card information.
• Refund policy: Fees are non-refundable once AI processing has begun on a claim. If you believe a charge was made in error, contact our support team within 30 days of the charge at support@insurifyai.app.
• Price changes: We reserve the right to change our pricing at any time. Price changes will not affect claims you have already activated.

When using the Service, you agree to:

• Provide accurate information: All claim details, documents, and information you submit must be truthful and accurate.
• No fraud: You will not use the Service to submit fraudulent claims, inflate damages, fabricate evidence, or engage in any form of insurance fraud.
• No misrepresentation: You will not represent AI-generated content as having been prepared by a licensed attorney or adjuster.
• Review AI outputs: You are solely responsible for reviewing, verifying, and deciding whether to use any AI-generated content.
• Comply with laws: You will comply with all applicable federal, state, and local laws when using the Service.
• No abuse: You will not attempt to reverse-engineer, hack, overload, or interfere with the Service.

9. Data Handling & Privacy

Your privacy matters to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to the data practices described in the Privacy Policy, including the processing of your claim data by AI systems and third-party service providers.

10. Voice Recording Consent

Certain features of the Service, including call coaching, involve the recording and transcription of voice audio. By using these features:

• You acknowledge and consent to the recording of your voice for the purpose of AI-powered coaching analysis.
• Voice recordings are processed by our third-party speech recognition provider (Deepgram) and are governed by our data processing agreements.
• In states that require two-party consent for recording (e.g., California, Florida, Illinois), you must obtain consent from all parties before using the call coaching feature during a live call.
• You will be prompted for explicit consent before each recording session. You may decline and still use other features of the Service.

11. Intellectual Property

The Service, including its design, software, algorithms, text, graphics, and logos, is owned by InsurifyAI LLC and is protected by copyright, trademark, and other intellectual-property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

Content you provide to the Service (claim details, uploaded documents, etc.) remains yours. By uploading content, you grant InsurifyAI a limited, non-exclusive license to process and store that content solely for the purpose of providing the Service to you. AI-generated outputs created using your data are licensed to you for personal use in connection with your insurance claims.

12. Limitation of Liability

To the maximum extent permitted by applicable law, InsurifyAI and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Loss of profits, data, or claim outcomes.
• Reliance on AI-generated content or recommendations.
• Actions taken or not taken based on coaching suggestions or strategy guidance.
• Inaccuracies in settlement estimates or claim analyses.
• Service interruptions or downtime.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to InsurifyAI in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless InsurifyAI, its affiliates, officers, directors, employees, agents, and licensors from and against all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; (d) any claim data or content you provide through the Service; or (e) your use of AI-generated content in connection with insurance claims or legal proceedings.

14. Dispute Resolution & Arbitration

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in Wilmington, Delaware, or at your election, may be conducted remotely.

Class Action Waiver: You agree that any arbitration or proceeding shall be conducted on an individual basis only, and you waive any right to participate in a class action, class arbitration, or any other representative proceeding.

Exceptions: Either party may seek injunctive or equitable relief in any court of competent jurisdiction for claims involving intellectual property or unauthorized access to the Service.

Opt-out: You may opt out of this arbitration provision by sending written notice to legal@insurifyai.app within 30 days of creating your account.

15. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, the Service, or third parties. Grounds for termination include, but are not limited to:

• Submitting fraudulent claim information.
• Abusing the Service or its AI features.
• Violating any applicable law.
• Non-payment of fees.

You may terminate your account at any time through the Settings page or by contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and dispute resolution) shall survive.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions.

17. Changes to These Terms

We may revise these Terms at any time by posting the updated version on this page with a new "Last updated" date. We will make reasonable efforts to notify you of material changes, such as through an in-app notification or email.

Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the changes, you should stop using the Service and close your account.
